By accessing or using the Posturia application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We will notify you of material changes via email or in-app notification.

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms, engaged in fraudulent activity, or abused the Service.

5. Subscription and Payments

5.1 Free and Premium Plans

Posturia offers both free and premium subscription plans. Free features may be limited in scope. Premium plans unlock additional AI scans, detailed analytics, priority support, and exclusive exercise programs.

5.2 Billing

• Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
• Payments are processed through the Apple App Store. Billing terms are subject to the applicable app store's terms and conditions.
• Prices are subject to change. We will notify you of any price increases at least 30 days in advance.

5.3 Refunds

Refund requests are handled according to the Apple App Store's refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact the respective app store.

6. User Content and Conduct

6.1 Your Content

You retain ownership of any photos, images, or other content you submit to the Service ("User Content"). By submitting User Content, you grant Posturia a non-exclusive, royalty-free, worldwide license to process, analyze, and store your content for the purpose of providing the Service.

6.2 Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Upload content that is offensive, harmful, or violates the rights of others.
• Attempt to reverse engineer, decompile, or disassemble the Service or its AI models.
• Use the Service to harass, abuse, or harm another person.
• Interfere with or disrupt the Service or its infrastructure.
• Create multiple accounts for fraudulent purposes.
• Scrape, crawl, or use automated means to access the Service without our consent.

7. Intellectual Property

The Service, including its AI technology, algorithms, design, text, graphics, logos, icons, and software, is the property of Posturia and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Posturia and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Any loss or damage caused by reliance on information obtained through the Service.
• Any personal injury or health issues resulting from exercises or recommendations provided by the Service.
• Any interruption, suspension, or termination of the Service.

In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Posturia, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of San Francisco County, California.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
